Terms of Service

By placing an order, making a payment, or using any service provided by NeptuneLaunch ("Company," "we," "us"), you ("Client") agree to be bound by these Terms of Service. Please read them carefully before purchasing.

1. Services provided

NeptuneLaunch provides custom website design, development, hosting, and related digital services on a managed subscription basis. All customer-facing websites are custom-built for the Client's specific industry and location; we do not resell a pre-made customer-facing template. Deliverables are outlined in the package selected at the time of purchase (Starter, Pro, or Elite), or in the one-time Design Only service.

2. Payment & billing

Managed packages include a one-time build fee charged at the time of order, plus a recurring monthly subscription charged on the same date each month thereafter. All payments are processed securely through Stripe. The one-time build fee is non-refundable once work has begun. Monthly subscription fees are billed in advance and are non-refundable for the current billing period. Add-on setup fees are one-time.

3. The 72-hour build condition

The 72-hour (three business day) build timeline begins only after the Client has completed the launch questionnaire and NeptuneLaunch has received and confirmed all required materials, including but not limited to: business name, address (if applicable), phone number, service description, target city and service area, photos, and any logos or branding materials. NeptuneLaunch is not responsible for delays caused by incomplete or late submission of Client materials. The 72-hour clock does not start until all required information is received and confirmed.

4. Subscription & cancellation

Your monthly subscription keeps your website live, hosted, and actively managed, and includes your package's allowance of update requests. You may cancel at any time by emailing NeptuneLaunch@gmail.com. Upon cancellation: (a) your website remains live until the end of the current paid billing period; (b) after that period, the managed website is taken offline; (c) NeptuneLaunch retains all website files, code, and design assets unless a separate written transfer agreement has been executed prior to cancellation; (d) domain management services cease and the Client is responsible for transferring or renewing their domain independently. Active monthly service is required to keep the managed website hosted and live.

5. Update requests & scope

An "update request" is a reasonable modification to your existing website — for example editing text, updating contact details or hours, swapping supplied photos, adjusting existing service information or pricing, small layout changes, or adding a supplied announcement. Starter includes four update requests per month; Pro includes ten; Elite includes unlimited reasonable update requests, submitted one at a time (no arbitrary monthly cap; requests are completed in a reasonable queue). The following are separate projects and are quoted separately: completely new websites, major redesigns or rebrands, new custom applications or portals, new ecommerce systems, complex databases, large integrations, extensive new page collections, new languages, and major copywriting outside the purchased page scope.

6. Domain names

Standard domain registration and renewal fees may apply separately and are not included in package pricing. Some domain names are classified as "premium" by registrars and may cost significantly more than standard pricing — in some cases $1,000 or more. Any premium domain acquisition costs are the sole responsibility of the Client and are not covered under any package. NeptuneLaunch will inform the Client of any premium domain costs prior to purchase. Domain management services remain active only while the monthly subscription is active.

7. Ownership of files & intellectual property

NeptuneLaunch retains ownership of all website files, source code, design assets, and intellectual property created during the build process unless a separate written agreement transferring ownership has been signed by both parties. The Client is granted a limited, non-transferable license to use the website while the monthly subscription remains active. Upon cancellation without a file transfer agreement, the license terminates and the managed website is taken offline.

8. Website transfers & buyouts

Clients interested in transferring or buying out their website may contact NeptuneLaunch before cancellation to discuss availability, scope, and any third-party licensing restrictions. Transfers, when available, are handled with a separate written quote. NeptuneLaunch does not publish a fixed buyout price, as it varies by project, third-party tooling, and scope. Any transfer terms and fees are agreed in writing.

9. Add-on services & third-party platforms

Add-on services (AI Chatbot, Email List & Automation Setup, Booking Calendar, Simple Payment Setup, Local SEO & Google Business Setup, Google Analytics & Monthly Report Setup) are one-time supplemental setup services. Some add-ons configure third-party platforms (for example email marketing, booking, analytics, or payment processors). Those platforms may charge their own ongoing fees and are governed by their own terms, policies, availability, and limitations. The Client owns and is responsible for their own third-party accounts, including fees, chargebacks, disputes, and compliance. For payment setup, NeptuneLaunch does not process, handle, or access Client funds or customer payment information; where setup requires access, the Client grants temporary, delegated access (for example via Stripe Team Members) that may be revoked at any time. The Local SEO add-on is a one-time setup service and does not include ongoing monthly SEO management, link building, content production, citation campaigns, review management, or guaranteed rankings.

10. Refund policy

The one-time build fee is non-refundable once NeptuneLaunch has begun work (typically within 24 hours of receiving Client materials). If work has not yet begun, a full refund may be requested within 48 hours of payment. Monthly subscription fees are non-refundable. Add-on one-time fees are non-refundable once the service has been initiated. For a suspected billing error, contact NeptuneLaunch@gmail.com within 7 days of the charge.

11. No guaranteed results

NeptuneLaunch builds websites using current on-page and technical SEO practices, but does not and cannot guarantee any specific search ranking, map placement, lead volume, conversion rate, or revenue. Search rankings and local visibility are controlled by third parties (such as Google) and depend on many factors outside our control.

12. Client responsibilities

The Client is responsible for: (a) providing accurate and complete business information; (b) ensuring all content, images, and materials submitted do not infringe third-party rights; (c) maintaining their own domain registration and renewals if not managed by NeptuneLaunch; (d) compliance with all laws applicable to their business, website content, and any payment processing. NeptuneLaunch is not responsible for content provided by the Client.

13. Limitation of liability

NeptuneLaunch shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of revenue, business, or data. Our total liability for any claim arising from our services shall not exceed the total amount paid by the Client to NeptuneLaunch in the three (3) months preceding the claim.

14. Dispute resolution

In the event of a dispute, the Client agrees to first contact NeptuneLaunch at NeptuneLaunch@gmail.com to attempt informal resolution. If a dispute cannot be resolved informally within 30 days, both parties agree to binding arbitration in the State of New York under the rules of the American Arbitration Association. Class action lawsuits are expressly waived. These Terms are governed by the laws of the State of New York.

15. Modifications to terms

NeptuneLaunch reserves the right to update these Terms of Service at any time. Continued use of our services after changes constitutes acceptance of the new Terms. We will make reasonable efforts to notify active subscribers of material changes via email.

16. Acceptance

By completing a purchase through our website or Stripe checkout, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service. If you do not agree, do not purchase or use our services.
