By placing an order, making a payment, or using any service provided by NeptuneLaunch ("Company," "we," "us"), you ("Client") agree to be bound by these Terms of Service. Please read them carefully before purchasing.
By completing a purchase through our website or Stripe checkout, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.
NeptuneLaunch provides custom website design, development, hosting, and related digital services on a subscription basis. All websites are custom-built for the client's specific industry and location. We do not use pre-made templates. Deliverables are outlined in the package selected at the time of purchase (Starter, Pro, or Elite).
All purchases include a one-time build fee charged at the time of order, and a recurring monthly subscription charged on the same date each month thereafter. All payments are processed securely through Stripe. The one-time build fee is non-refundable once work has begun. Monthly subscription fees are billed in advance and are non-refundable for the current billing period.
The 72-hour build timeline begins only after the Client has submitted all required business information to NeptuneLaunch@gmail.com, including but not limited to: business name, address, phone number, service description, target city, photos, and any logos or branding materials. NeptuneLaunch is not responsible for delays caused by incomplete or late submission of client materials. The 72-hour clock does not start until all required information is received.
Your monthly subscription keeps your website live, hosted, and actively managed. You may cancel your subscription at any time by emailing NeptuneLaunch@gmail.com. Upon cancellation:
(a) Your website will remain live until the end of the current paid billing period.
(b) After the billing period ends, the website will be taken offline.
(c) NeptuneLaunch retains all website files, code, and design assets unless a separate written file transfer agreement has been executed prior to cancellation.
(d) Domain management services will cease and the client is responsible for transferring or renewing their domain independently.
Standard domain registration and renewal fees may apply separately and are not included in website package pricing. Some domain names are classified as "premium" by domain registrars and may cost significantly more than standard pricing — in some cases $1,000 or more. Any premium domain acquisition costs are the sole responsibility of the Client and are not covered under any NeptuneLaunch package. NeptuneLaunch will inform the Client of any premium domain costs prior to purchase. Domain services remain active only while the monthly subscription is active.
NeptuneLaunch retains ownership of all website files, source code, design assets, and intellectual property created during the build process unless a separate written agreement transferring ownership has been signed by both parties. The Client is granted a limited, non-transferable license to use the website while the monthly subscription remains active. Upon cancellation without a file transfer agreement, the license terminates and the website will be taken offline.
Add-on services (AI Chatbot, Email List Setup, Booking Calendar, Simple Payment Setup, Local SEO Setup, Google Analytics) are provided as supplemental services. Simple Payment Setup involves configuring third-party payment processors (Stripe or Square) on the client's behalf. The Client is solely responsible for their own Stripe or Square account, including fees, chargebacks, disputes, and compliance with applicable payment regulations. NeptuneLaunch does not process, handle, or have access to client funds or customer payment information. Client grants NeptuneLaunch temporary Developer-level access to their Stripe account via Stripe's Team Members feature for setup purposes only. This access may be revoked by the Client at any time.
The one-time build fee is non-refundable once NeptuneLaunch has begun work on the website (typically within 24 hours of receiving client materials). If work has not yet begun, a full refund may be requested within 48 hours of payment. Monthly subscription fees are non-refundable. Add-on one-time fees are non-refundable once the service has been initiated. If you believe there has been a billing error, contact NeptuneLaunch@gmail.com within 7 days of the charge.
The Client is responsible for: (a) providing accurate and complete business information; (b) ensuring all content, images, and materials submitted do not infringe on third-party intellectual property rights; (c) maintaining their own domain registration and renewals if not managed by NeptuneLaunch; (d) compliance with all applicable laws regarding their business, website content, and any payment processing. NeptuneLaunch is not responsible for any content provided by the Client.
NeptuneLaunch shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of revenue, loss of business, or loss of data. Our total liability to you for any claim arising from our services shall not exceed the total amount paid by you to NeptuneLaunch in the three (3) months preceding the claim. NeptuneLaunch does not guarantee any specific results, rankings, leads, or revenue from the website or any add-on services.
In the event of a dispute, the Client agrees to first contact NeptuneLaunch at NeptuneLaunch@gmail.com to attempt informal resolution. If a dispute cannot be resolved informally within 30 days, both parties agree to binding arbitration in the State of New York under the rules of the American Arbitration Association. Class action lawsuits are expressly waived. These Terms shall be governed by the laws of the State of New York.
NeptuneLaunch reserves the right to update these Terms of Service at any time. Continued use of our services after any changes constitutes acceptance of the new Terms. We will make reasonable efforts to notify active subscribers of material changes via email.
